UNSUPPORTED HEARSAY CONTAMINATES RECORD
June 26, 2026 letter to Criminal Justice Training Commission:
The attached June 10, 2026 email from Blaine Chief of Police Rodger Funk’s legal counsel Rebecca Singleton to CJTC Investigations Division Manager Mike Devine asserts that an FBI Special Agent informed Chief Funk that the FBI was declining to investigate complainants requests (presumably regarding racketeering by Blaine officials), and was “flagging all the complainants in their system.” This harmful hearsay is unsupported by any attached FBI letter, case record, formal declination, database notice, or written verification. CJTC should not have relied on this statement without independently confirming it with the FBI and providing complainants an opportunity to respond.
The FBI flagging claim by counselor Singleton on behalf of respondent Funk should be treated as unverified, prejudicial, and material. It strengthens the argument that the CJTC may have relied on one-sided defense assertions without interviewing the actual complainants. It does not belong in the public record that apparently misled CJTC staff involved. Case reviewers and managers should never have accepted this misconduct, and should report Singleton to the Washington Bar Association.
Please produce all CJTC records reflecting any verification of the alleged FBI statement, including communications with Special Agent Andy Weathers, FBI Seattle, FBI Phoenix, Chief Funk, Rebecca Singleton, or any FBI employee concerning the complainants, the complaints, or any alleged “flagging” of complainants in FBI systems. As you have indicated that I will not receive all my public records requested earlier this month until August, and this request might be even longer, the current reopened investigation cannot reasonably proceed for at least two months. In my view, the CJTC has failed so miserably that it cannot produce a trusted result, and must refer the three cases to the FBI.
I and the other two complainants cannot be expected to defend ourselves from frivolous claims by opposing legal counsel, ongoing intimidation by Blaine officials during the CJTC investigation, and demonizing by State Senator Shewmake, while CJTC staff betray all promises made to us about a fair, unbiased process. If the FBI was involved in tainting our cases, then the only remedy is federal court, and the CJTC would become a defendant along with the City of Blaine and the City of Ferndale.
