September 26 letter to Whatcom County Planning Commission:
The scheduled October 9 UGA presentation by Blaine Community
Development Services director Alex Wenger requires an orientation to felony
fraud committed by Mr. Wenger that directly harms the Drayton Harbor
watershed and Waters of the United States.
The June 14, 2025 Formal Complaint by Blaine Water Coalition to the U.S.
Department of Justice, Washington State Attorney General, and Washington
State Auditor alleges criminal conduct and ethical violations in connection with
the City of Blaine 2025 Urban Mixed-Use rezoning action (included in the
Blaine UGA element). This is the latest example in a documented pattern of
regulatory non-compliance and enforcement failures by the city, which are the
subject of existing complaints before the Department of Ecology.
In the June complaint, we reveal that Alex Wenger hired a consultant to
rewrite Blaine zoning laws to favor the financial interests of developers, and
altered the public record (File #2025006) by omitting public comments from
Blaine Water Coalition in his Planning Commission Recommendation to the
City Council before its vote on Ordinance 25-3028. Creek setbacks and
stormwater management were relaxed or eliminated in the rezoned areas.
Injury to a Public Record is a Class C felony under RCW 40.16.010.
At the outset of the public hearing, Mr. Wenger actively discredited and
dismissed Blaine Water Coalition's substantive comments before they were
even presented, shaping the Commission's perception and ensuring no
dissenting information would interfere with the predetermined outcome.
Commissioner Randhawa failed to recuse himself due to his direct financial
conflict of interest as the listed agent (Freeman Real Estate) on the rezoned
properties. Under oath, Randhawa stated at the hearing that he did not have
any conflict of interest. His vote increased his real estate commission rate by
approximately $50K.
