REPEAL ORDINANCE 25-3028

Dear Council member, 

The compliant recently filed and referred to the DOJ and AG is in your council packet for this coming Monday. Please consider the following for your new business motion. I look forward to your response on this matter. A lack of response on this request and communication is also important to me as well. 

Motion to Repeal Ordinance- Invalidation of Blaine Ordinance 25-3028 

I move that the Blaine City Council repeal Ordinance 25-3028 on the grounds that its passage violated both state and local laws regarding conflicts of interest and ethical conduct. Specifically: 

  • Council members Randhawa and CDS Director Alex Wenger failed to disclose personal or financial conflicts of interest prior to participating in discussion and voting, contrary to RCW 42.23.070, RCW 42.23.030, and the Blaine Municipal Code. 
  • The Council Rules of Procedure and the City’s adopted or proposed Code of Ethics require disclosure and recusal in such circumstances, which did not occur. 
  • The failure to disclose and recuse undermines the integrity of the Council’s proceedings and the validity of the ordinance, warranting its repeal in accordance with BMC 1.01.020, 1.01.050, and 1.04.090. 
  • The Council should investigate the matter further and consider additional measures to ensure compliance with ethical and legal standards in future proceedings 

I request that this motion be placed on the agenda for the next regular Council meeting in accordance with the Council Rules of Procedure
