No EIS for Blaine UGA Swap

The City of Blaine proposes to place a 2025 'UGA Swap' ballot measure before Blaine voters to approve a new Urban Growth Area (UGA) on the west side of the Semiahmoo Peninsula without first producing an Environmental Impact Statement (EIS), as required by the State Environmental Policy Act (SEPA) and the Growth Management Act (GMA). The new West Blaine UGA is proposed to replace the 500 acres recently removed from the East Blaine UGA, unlawfully located in the Critical Aquifer Recharge Area (CARA) where the city intentionally and illegally avoided doing an EIS, which under state law is mandatory in CARAs.
Voting on a city ordinance that in itself violates SEPA, GMA, and the federal Clean Water Act is not legal. Blaine cannot pass laws by the city or voters that violate state and federal laws. The ballot measure cannot thus be legally placed on the ballot. Whatcom County, which has to approve the new UGA, should intervene immediately to protect Blaine citizens and our environment by shutting down this latest episode of criminal enterprise by the City of Blaine.
